About the Department
PERC is an independent state agency created to implement Washington State’s eleven collective bargaining laws and resolve public-sector labor relations disputes. PERC has jurisdiction over collective bargaining for public employers in Washington. PERC mediates and adjudicates disputes, determines appropriate bargaining unit configurations and conducts representation elections, and provides training and other conflict prevention services. The agency has jurisdiction over certain labor-management relations matters involving employees of the State of Washington, cities, counties, school districts, community colleges, higher education institutions, ports, fire districts, public hospitals, public utility districts, and a small segment of private employees. PERC is governed by a three-member Commission comprised of part-time Commissioners who have expertise in collective bargaining law. The Commission is charged with the authority to hire the Executive Director, adopt rules to govern the operation of the agency and resolve disputes under the relevant law. As a practical matter, the Commission serves as the appellate board for decisions issued by the Executive Director and approximately 16 mediators/adjudicators employed by the agency.
The Public Employment Relations Commission (PERC) is recruiting for one permanent full-time position in the Labor Relations Adjudicator/Mediator 3 (LRAM 3) classification as an Unfair Labor Practice (ULP)/Representation Administrator. This recruitment may be filled in Olympia or Kirkland, Washington.
As a senior LRAM specialist, under the delegated authority of the Executive Director, the ULP/Representation Administrator helps effectuate the agency mission by processing unfair labor practice (ULP) complaints, representation, and unit clarification petitions. This permanent full-time position reports directly to the Executive Director and is overtime-exempt.

Position Duties
Primary Duties
- Review and process representation and unit clarification petitions. Work with parties to investigate cases; plan, schedule, and coordinate representation elections; issue investigation statements and election notices; facilitate representation elections, draft certification for executive director’s signature, prepare for hearings and decisions.
- Engage in discussions with representation and unit clarification case parties to help them prepare for hearing or resolve the case without hearing. Help parties make informed decisions by providing guidance on likely outcomes of the proceedings based on agency rules and case precedents. Help ensure that the resulting units are appropriate under PERC standards.
- Schedule and conduct prehearing conferences and hearings. Strive to resolve differences prior to hearing. Draft decisions for the executive director’s signature. Process resulting election proceedings after hearing.
- Participate in case discussions with the executive director and LRAMs regarding legal principles of representation and unit clarification cases. Edit representation and unit clarification decisions that have been drafted by other labor relations adjudicators/mediators (LRAMs) for the executive director’s signature.
- Review and process unfair labor practice (ULP) complaints. Apply agency precedent and decide whether ULP complaints meet jurisdictional standards. Issue cause of action statements or deficiency notices, giving complainants the opportunity to amend their complaints. Dismiss complaints if deficiencies are not corrected.
- Review draft ULP orders of LRAM decisions to ensure consistency with agency practice and precedent. Work with parties to reach compliance with agency orders. Prepare information about parties’ compliance for the executive director’s acceptance or further proceedings.
- Manage multiple and varying case queues and keep Salesforce, parties, and other PERC personnel updated regarding case status. As appropriate, maintain an individual caseload of unit clarification, representation, mediation, unfair labor practice or training cases.
- Respond to calls and emails from the public, providing information about the agency and its processes.
Minimum Qualifications
Preferred Qualifications:
- A law degree and significant experience in collective bargaining, as a hearing officer examiner, mediator, arbitrator or educator in these areas. A master’s degree in labor relations, personnel management, or closely allied field will substitute, year for year, for a law degree. Additional qualifying experience may substitute, year for year, for education.
- Authoritative knowledge/command of statutes, rules and case law governing representation, unit clarification, and unfair labor practice issues.
- Demonstrated expertise in opinion writing and hearing skills. This includes the ability to draft and edit unit clarification and representation decisions for the executive director’s signature. Must demonstrate the ability to critically analyze and organize the relevant facts, arguments, and conclusions of law in a clear and logical sequence after reviewing of the record, legal briefs, and case precedents.
- Demonstrated ability to mentor others, as well as explain complex statutes and rules and apply them in terms that any and all interested parties can understand.
- Demonstrated ability to respond to difficult and stressful situations in a manner that reduces or minimizes potential conflict and maintains good working relationships among clientele and colleagues.

Retirement and Deferred Compensation
State Employees are members of the Washington Public Employees' Retirement System (PERS). New employees have the option of two employer contributed retirement programs. For additional information, check out the Department of Retirement Systems' web site.
Employees also have the ability to participate in the Deferred Compensation Program (DCP). This is a supplemental retirement savings program (similar to an IRA) that allows you control over the amount of pre-tax salary dollars you defer as well as the flexibility to choose between multiple investment options.
Social Security
All state employees are covered by the federal Social Security and Medicare systems. The state and the employee pay an equal amount into the system.

Holidays
Full-time and part-time employees are entitled to paid holidays and one paid personal holiday per calendar year.
Note: Employees who are members of certain Unions may be entitled to additional personal leave day(s), please refer to position specific Collective Bargaining Agreements for more information.
Full-time employees who work full monthly schedules qualify for holiday compensation if they are employed before the holiday and are in pay status for at least 80 nonovertime hours during the month of the holiday; or for the entire work shift preceding the holiday.
Part-time employees who are in pay status during the month of the holiday qualify for the holiday on a pro-rata basis. Compensation for holidays (including personal holiday) will be proportionate to the number of hours in pay status in the month to that required for full-time employment, excluding all holiday hours. Pay status includes hours worked and time on paid leave.
Sick Leave
Full-time employees earn eight hours of sick leave per month. Overtime eligible employees who are in pay status for less than 80 hours per month, earn a monthly proportionate to the number of hours in pay status, in the month to that required for full-time employment. Overtime exempt employees who are in pay status for less than 80 hours per month do not earn a monthly accrual of sick leave.
Sick leave accruals for part-time employees will be proportionate to the number of hours in pay status, in the month to that required for full-time employment. Pay status includes hours worked, time on paid leave and paid holiday.
Vacation (Annual Leave)
Full-time employees accrue vacation leave at the rates specified in WAC 357-31-165(1) or the applicable collective bargaining agreement (CBA). Full-time employees who are in pay status for less than 80 nonovertime hours in a month do not earn a monthly accrual of vacation leave.
Part-time employees accrue vacation leave hours in accordance with WAC 357-31-165(1) or the applicable collective bargaining agreement (CBA) on a pro rata basis. Vacation leave accrual will be proportionate to the number of hours in pay status, in the month to that required for full-time employment.
Pay status includes hours worked, time on paid leave and paid holiday.
As provided in WAC 357-58-175, an employer may authorize a lump-sum accrual of vacation leave or accelerate the vacation leave accrual rate to support the recruitment and/or retention of a candidate or employee for a Washington Management Service position. Vacation leave accrual rates may only be accelerated using the rates established WAC 357-31-165.
Note: Most agencies follow the civil service rules covering leave and holidays for exempt employees even though there is no requirement for them to do so. However, agencies are required to adhere to the applicable RCWs pertaining holidays and leave.
Military Leave
Washington State supports members of the armed forces with 21 days paid military leave per year.
Bereavement Leave
Most employees whose family member or household member dies, or for loss of pregnancy, are entitled to five (5) days of paid bereavement leave. In addition, the employer may approve other available leave types for the purpose of bereavement leave.
